For ex-White House attorney Ty Cobb, former President Donald Trump is set to win in runaway fashion on his potential appeal to the U.S. Supreme Court (SCOTUS) against being removed from the presidential primary ballot as ruled by the Colorado Supreme Court (CSC).
“I think this case will be handled quickly. I think it could be 9-0 in the Supreme Court for Trump,” Cobb said in an interview on CNN. Later on, he expressed the belief that the landslide decision was inevitable because “the law is clear.”
Citing the Fourteenth Amendment’s “insurrection clause,” the CSC’s 4-3 ruling argued that Trump engaged in an insurrection by promoting false claims of election fraud and encouraging supporters to go to the Capitol on Jan. 6, 2021. Thus, listing him as a candidate on the 2024 presidential primary ballot would be a “wrongful act.”
“The real key issue in this case is – is Trump an officer in the U.S. in the context in which that term is used in Article 3 of the Fourteenth Amendment,” Cobb said. “And in 2010, Chief Justice John Roberts explained in free enterprise that people don’t vote for officers of the United States.”
He also cited multiple Supreme Court decisions that do not conclude officers include the president or vice president in this context. He also predicted that the high court will not hesitate to move quickly on this because they know what the stakes are, as well as their responsibility. “They can delay some of these Colorado dates to the extent that they feel they’re obligated to or have to,” he continued.
Cobb further argued the ruling vindicates Trump’s “insistence that this is a political conspiracy to interfere with the election and that he’s the target and people shouldn’t tolerate that in America.”
The CSC put its ruling on hold until Jan. 4 to allow Trump to first seek review from the SCOTUS; if he does, his name will automatically remain on the ballot until justices resolve the appeal. The ruling also only applies to Colorado, so it leaves Trump still able to run in other Republican primaries, the state-by-state search by each party for a presidential nominee. The former president is seen far ahead of his party rivals so it is still possible for him to win the primaries without competing in the Centennial State, analysts opined.
Trump campaign spokesman Steven Cheung vowed they would appeal the ruling to the high court, which has a 6-3 conservative majority and includes three justices nominated by the former president.
Following the “controversial” CSC decision, Republicans largely lined up behind Trump, railing against the ruling for allegedly infringing the right of Americans to choose their leaders. They include Trump’s party rivals Vivek Ramaswamy and Florida Gov. Ron DeSantis.
Ramaswamy pledged to drop out of the GOP primary in Colorado, piling pressure on his fellow candidates to do the same or be seen as “tacitly endorsing this illegal maneuver which will have disastrous consequences for our country.” Meanwhile, DeSantis voiced an unusual theory that the Colorado decision was, in fact, a move from Democrats to incite Trump’s base and deliberately help him win the primary.
“They’re doing all this stuff to basically solidify support in the primary for him, get him into the general, and the whole general election’s going to be all this legal stuff,” he told NBC News. “It will give Joe Biden or the Democrat, whoever, the ability to skate through this thing.”
The former president did not address the decision during a rally in Iowa, but posted about the ruling on his social media platform Truth Social. “What a shame for our country” and “a sad day for America,” Trump said of the ruling.
Rep. Elise Stefanik (R-NY) said in a statement: “Democrats are so afraid that President Trump will win on Nov. 5, 2024 that they are illegally attempting to take him off the ballot.” (Related: RFK Jr. skewers Colorado Supreme Court decision to block Trump from 2024 ballot: “That’s not a real democracy.”)
